as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements).
Do not email or otherwise transmit any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other
form of solicitation.
Do not upload, post, email or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or
limit the functionality of any computer software or hardware or telecommunications equipment.
Do not interfere with or disrupt our sites, services or servers or, or disobey any requirements, procedures, policies or regulations of networks connected to the Service.
Here are some examples of interference or disruption: inappropriate use of mail relay, wide-scale distribution of messages to inappropriate forums or mailing lists,
propagation of computer worms or viruses, and use of the network to make unauthorized entry to other devices or resources. This includes unauthorized security probing
activities or other attempts to evaluate the security integrity of a network or host system without permission.
Do not "stalk" or otherwise harass people.
Do not collect or store personal data about other users or harvest or otherwise collect information about others, including e-mail addresses, without their consent.
Enforcement and Violations
TakeActionMarketing.com's customers or partners must enforce the TakeActionMarketing.com Acceptable Use Policy at their own sites. The failure of TakeActionMarketing.com to exercise or enforce any right or
provision of this Acceptable Use Policy will not constitute a waiver of such right or provision.
If TakeActionMarketing.com becomes aware that a customer or partner is in violation of the law or this Acceptable Use Policy, TakeActionMarketing.com reserves the right to impose disciplinary
action in its sole discretion. Our disciplinary action may include: the expulsion of the customer from TakeActionMarketing.com web sites and termination of TakeActionMarketing.com services.
Evidence of criminal activities may be disclosed to law enforcement authorities. If this Acceptable Use Policy is violated, TakeActionMarketing.com, in its sole discretion, may
terminate your password, account (or any part thereof) or use of our services, with or without notice. TakeActionMarketing.com will not be liable to you or any third-party for any
termination of your access to our services.
You agree to indemnify and hold TakeActionMarketing.com, and its affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand,
including reasonable attorneys' fees, made by any third party due to or arising out of content you submit, post to or transmit, your use of our services, your connection to
the service, your violation of this Acceptable Use Policy, or your violation of any rights of another.
